Terms and Conditions of Response
The Material on this website is available for users to access, conditional upon user’s acceptance to terms and conditions. The user also acknowledges that in addition to the terms of service of Response, both the user and Response, These additional terms of service include, but are not limited to, the Acceptable Users policy.
Response is real estate company, It provides the opportunity for sellers to list their property, Response divided Selling and renting listed property to all its franchises to find the best price for each property.
All the charges attracts VAT and are subject to changes,
New listings will be vetted prior to being uploaded to Response website and exported to third party portals. Please allow time for your listing to be verified and be uploaded to our system. This is generally only a few minutes within our extended business hours. Listings completed after 7PM may not be vetted/activated until the following morning.
It is the responsibility of the user to keep their username and password secure. Sharing username and password is forbidden under Response Terms of Service. If you believe that your username and password has been breached, please notify Response immediately. email@example.com
There is no minimum term for sign up. The property is active by Response until the user chooses to de-activate, or if the property is sold/rented.
Sellers warrant that they are either the legal owners of the property displayed and/or have the legal entitlement to sell the property example by way of Power attorney. Sellers must be able to supply proof of ownership to Response. Proof of ownership such as copy of title dead/ Oquood. Sells and purchase agreement, the mentioned above must be provided before a listing will be activated.
Following information to list your property is Mandatory
1. Title deed copy( proof of ownership)
2. Passport copy of owner or owners
3. A complete application form with property details
4. Completed Response real estate listing authority(rera form)
Seller/Landlord shall not provide dishonest or misleading information about their property to Response. An example of a misleading comment could be ‘no deposit needed’ when in fact a deposit is asked for. Another example may be ‘Sea or Marina views’ when such views are not genuinely available from a normal viewing position within the property. That may constitute false or misleading information within a real estate advertisement.
Images and text supplied to Response must be owned and/or created by the Seller/ Landlord. Any use of images owned by third parties must only occur where a written authority has been obtained by the Owner/Landlord from the legal or copyright owner of the images or data. Any images supplied must be actual photos of the property for sale or lease.
Seller/Landlord must provide the correct legal (generally on the title deed) address of the property listed. Seller/Landlord must use the true and accurate Tower, area, building name which represents the legal address of the property for sale. No vanity attempts may be made to secure greater search results by falsifying a correct legal address by using a more prominent adjoining area.
Seller/Landlords should consider whether they are in any legally binding contract for sale or rent with, either another real estate agent or person prior to marketing on Response website.
Seller/Landlords must be responsive to enquiries from buyers and/or tenants and Response within a reasonable timeframe. If a Seller /Landlords is going to be away or otherwise unable to respond to enquiries, they must pause their listing, provide alternative contact information, or otherwise advise Response of the situation via email, phone, or SMS.
Rental properties must be current in order to be advertised. Current here means that the property is available for Rent within six weeks or less. When Properties are rented. They must be removed from Response system within 7 days.
It is not permitted to keep a property active and/or simply extend the availability date whilst that specific property is rented or not available. For example "reusing" the same space for renting another property in the future (e.g. after the end of tenancy attained through a prior round of advertising) or leaving a property online to get enquiries for other properties.
Response is reliant on other third party sites which Response subscribes to and pays fees to access. Such sites may alter without notice. Response reserves the right to add or delete any third party portal from its list of exported destinations without advance notice to existing users of Response.
The third party use of any website within the Response export is at the sole discretion of Response.
Response does not and cannot provide any guarantee regarding the continuity of these relationships. You, the user, indemnify Response from any actions on your behalf should Response be unable to provide access to any of its third party sites at any stage.
Response exports listing data to third-party portals automatically via Domain XML/REAXML meeting all listing field requirements. Whilst Response will work with third-party portals to resolve issues where possible, vendors must acknowledge that Response does not have any control over how third-party portals choose to style and order their website and listings.
Whilst Response personally checks all property changes, the Seller/Landlord is ultimately responsible for the content which uploaded to the system. Response advises regular checks by the Sellers to ensure their satisfaction with quality and content of listings on various websites.
It is a condition of use of Response services that Seller/Landlords are at all times respectful and courteous in their dealings with Response staff members. Abusive behavior of any kind will not be tolerated.
Any breach of these Terms and Conditions by a user may result in the user’s property being removed from Response website.
Unauthorized use of this site prohibited
Any person who uses this site without proper and lawful authority agrees to indemnify and keep indemnified Response against all and any liability, loss and damage of any kind caused by such improper and unlawful use.
You, as user, agree that in accessing information on Response you release Response, to the extent permitted by law, from claims regarding usage of data or information available on the website. Response will not be accountable for incidental or consequential damages ensuing from use of the data or information.
Response does not warrant that the website or any of its content will be available on a secure, virus free, continuous or uninterrupted basis. Response is not liable for any damage or loss suffered by users that may occur as a result of their inability or the inability of other users to access any of the content on the website.
Response provides no guarantees, undertakings or warranties regarding the correctness, comprehensiveness or currency of information, or its fitness for any paying or free user’s purpose or intent. Users are advised to confirm information at their discretion.
Information changed post-publication can alter information accuracy, and Response does not assure the information accuracy or guidance therein. Websites linked to from Response are not controlled by Response. Users must decide for themselves the correctness, comprehensiveness, trustworthiness and currency of information on third party sites.
Response Real Estate broker trading as Response, is a Licensed real estate agency (License Number is – 588387 and Dubai Rera number is 324) operating under UAE Laws and real estate industry RERA.
Notwithstanding the above Terms and Conditions, Response shall abide by all relevant UAE laws and should any new law change which affects the definition or interpretation of these terms Response may change these terms as a result without notice.
Response is committed to safeguarding your privacy in accordance with law of United Arab Emirates, Response will take all reasonable steps to preserve the security of all the users’ personal information, however users agree that accessing response website will be at their own risk.
